Falun Dafa again before the Constitutional Court of Serbia

11 February 2018

The Human Rights House is concerned about the constant violation of human rights of the activists of the Association of Serbian-Chinese Friendship FDH by the Ministry of Internal Affairs on the territory of Belgrade. The latest prevention of assembly of activists and the organization of signing a petition took place on the Republic Square in Belgrade on December 16, 2017 with the detention of 10 activists in the police for a period of 4 hours, due to which Jukom is now again submitting a constitutional complaint. This prevention happened despite the first decision of the Constitutional Court of Serbia on the violation of the constitutional rights of Falun Dafa activists in October 2017. The decision was made after three years from the China and 16 countries Summit in Belgrade, when the police banned 3 duly announced public assemblies. On that occasion 11 detainees from EU countries were detained, who arrived in Belgrade to raise awareness of the persecution of Falun Dafa in China and promote the EP Resolution on the organ harvesting in China. To remind, activists were deported from Serbia after 72 hours of retention.

The Constitutional Court has not yet ruled on the constitutionality of several ban on activists of Falun Dafa during the visit of the Chinese president to Serbia in 2016. Activists of this movement are protesting peacefully in all European countries, as a rule during visits of Chinese officials, since 1999, when the Communist Party of China began the persecution of Falun Dafa. Also, outside of Belgrade, their gatherings and protests are held without any restrictions.

We appeal to the Ministry of Internal Affairs to review the action against Falun Dafa activists and enable them to exercise freedom of assembly and the right to petition in accordance with the Constitution of the Republic of Serbia.
